» THE DEBTOR PAYMENT DEFAULT IN THE ARGENTINEAN LAW

Sumary

Payment default is a key concept in tort law. In 1968, the 17.711 Act, which amended the Civil Code, involved a major change in how debtors fall in payment default. In this paper, we intend to analyze the Section 509 of the Civil Code that deals with the subject: its writing as much as the solutions it establishes for different sorts of debtor-creditor relationships. Although the topic has been very much discussed – and long ago, a new discussion seems plausible facing a possible replacement of the whole Argentinean Civil Code. The regulation of the matter in the bill is also examined.
