» MEDICINES IN FRANCE: ARE COMPONENTS OF THE RIGHT TO HEALTH PROTECTION?

Sumary

Medicines are a component of the right to a medical treatment. This right is autonomous, but it contributes to the effectiveness of the right to health care. To put it in other terms, effectiveness of the right to health care depends of the access to a medical treatment, and, through it, the access to medicines. The problem of effectiveness is common to all rights within this category. However, in which concerns the right to health care, due to the focus made by political deciders on the efficiency of the health care system from a global point of view, it is legitimate to ask if this right’s nature is not being modified.
