Sumary

This article discusses the “democratic” objection against judicial review. First, it describes some assumptions underlying this objection. After that, arguments are offered to support judicial intervention under a deliberative democracy model. Finally, the article analyzes how the “democratic” objection contributes to improve judicial review. In particular, some models of gradual intervention are described as alternatives for a more democratic version of judicial review.
