Abstract
The Biological Diversity Agreement, signed in Rio de Janeiro-1992, is a special environmental, intellectual property and trade statement. It recognizes the sovereign rights of the States upon their own biological resources and the legitimacy of the indigenous people to share the benefits in equity as providers of their traditional knowledge. However the concreteness of these directive through the necessary modification adaptation of the legal regimes has not been accomplished The point of this proposal is the specific object to be protected: the ownership of the genetic resource coming from aboriginal species and the approbation of the indigenous peoples that provide their traditional knowledge, also those intellectually rights which origin is that traditional knowledge. It is needed to provide to the scientific researches a legitimate way to access to the principles of their job, this obligation has to be accomplished under the penalty of denouncing the protection of the Treaty. Moreover, the Latin-American States has to accomplish this task in a concerted way because they share most of those biological resources and indigenous people, which and who cannot be divided or separately taken into account.
