Abstract

Gioja, Faculty of Law – University of Buenos Aires Research period: 2011-2014 Governance, human sustainable development and ecosystem approach are an indivisible unit. The former embrace the State but transcends it by embracing the private sector and civil society. These three elements are at the core of sustainable development. On this ground, the specific objectives of the present project are: At macro scale (MERCOSUR): a) Identify indicators of effectiveness of environmental law by analyzing the work of Legislative, Executive and Judicial Powers of the MERCOSUR’s Member States, particularly Argentina b) Analyze the process, theoretical frameworks and legal asymmetries involved in those practices which try to convert the clean water in "commodity", and compare them with those that consider water as common good. Analyze the current water market and explore its empirical basis and paradigms. c) Systematize and analyze the national and international regulations applicable to coastal-marine management in the MERCOSUR’s countries. At micro scale (Case studies): d) Explore and identify the social representation of water in a few urban communities in Argentina that are riparian of some MERCOSUR river. e) Serious conflict scenario: explore and describe the consequences of armed conflict in Colombia, its adverse effects on the environment and water resources and the displacement of native populations. Identify the public policis to manage the case in the light of international humanitarian law. f) Low-conflict scenario: explore and describe the conditions for sustainable management in the MaB Reserve on the Paraná Delta (Buenos Aires), identifying the local and international competing policies. Analyze physical, chemical and biological features in selected waterways. Assessing social perception of water among residents of the reserve, with a view to setting up a monitoring network This is an intradisciplinary and interdisciplinary research, descriptive-explanatory and even predictive, since it also will explore the factors that influence individual and collective behaviour, in order to facilitate decision making by public authorities or private involved. Because one of the possible purposes of this research plan is to create a monitoring network in the Biosphere Reserve of the Paraná delta, the project can be also described as action research.
